West Virginia CBD Oil Laws


Among the pioneering states in terms of industrial hemp cultivation laws, West Virginia has this kind of law since 2002. The state also has allowed the use of medical marijuana in 206, but this law is not yet operational. The use of CBD oil and other CBD products is free for all West Virginians.

CBD Laws In The Mountain State

According to Senate Bill 447, industrial hemp with less than 1% THC in West Virginia is recognized as an agricultural crop and is legal to plant, grow, harvest, possess, process and sell commercially. This law was amended several times, with more provisions added and rules that have facilitated the licensing process. This resulted in 155 acres of hemp being grown in West Virginia in 2018.

Fundamentals of CBD Oil

Cannabis plants come in two main varieties: cannabis sativa and cannabis indica, plus a third variety known as cannabis ruderalis that has less common uses. Cannabis sativa also comes in two main varieties: one that produces plenty of THC and is psychoactive, known as marijuana, and another that produces very little THC (less than 0.3%) and lots of CBD, called industrial hemp which does not have any psychoactive properties.

The industrial hemp in the US is mainly used for the extraction of CDB and the production of CBD-based products. The rest of the plants left after the extraction process is used mainly as animal feed or animal bedding. The CBD is used for treating many conditions, as it helps with pain management, seizures, depression, PTSD, nausea, and plenty of other debilitating health conditions.

CBD is extracted from the raw plant materials by two main extraction processes: CO2 extraction and ethanol extraction. Both produce high yields of whole plant extracts that are free from solvents and are pure and safe for people to use.

  • CO2 extraction is more superior, producing a better quality product and allowing about 90% efficacy in extracting the desired CBD and other cannabinoids from the raw materials, but this process is more costly and more energy-consuming.
  • Ethanol extraction is a process that also provides a very pure extract and is able to draw out most of the desired compounds from the plants and is cheaper to run, but since ethanol is highly flammable, this can be an issue that needs to be adequately handled.

Among the many, and I mean many varieties of marijuana and hemp, there are strains that have varied THC and CBD contents and these are very favored by the medical marijuana users for their powerful medicinal effects. Here I bring you two such strains that have good amounts of CBD and THC.

  • Avi-Dekel is an Israeli strain that is very rich in CBD and has very little THC. This strain has powerful medicinal effects brought forth by the almost 16% CBD and 1% THC. The buds smell of sweetness and pines and have an earthy, piney, and sweet flavor. The initial effects are relaxed, happy, and uplifted, with a slight increase in focus and energy. The medical side is much more potent with strong pain-relieving properties, reducing stress and inflammation, helping with depression, and headaches.
  • CBD Lemon Potion has a 2:1 CBD vs. THC, with CBD levels going up to 15%. These smell of lemons, pines, and spices and have a strong lemony flavor. The effects of CBD Lemon Potion are happy feelings, relaxed and creative state of mind accompanied by a strong medicinal side. This strain is useful when dealing with headaches, pain, insomnia, anxiety, and stress.

West Virginia CBD law

This state has an established hemp cultivation program since 2002, recognizing industrial hemp with less than 1% THC as an agricultural cash crop. This law allows commercial growing of this crop, and after several changes over the years, the full law appoints a Commissioner of Agriculture to run the West Virginia Industrial Hemp Development Program.

The hemp grown in the State of West Virginia is mainly used for the production of CBD and animal feed and animal bedding. Due to the facilitated licensing processes, there has been a significant increase in the interest of farmers in this crop.

Medical marijuana

The West Virginia state legislators have voted on a law allowing the use of marijuana for medicinal applications in 2016, the West Virginia Medical Cannabis Act which was signed into law on April 19, 2017. Still, up to this day, this law is not operational and it seems like it will be in 2020 or 2021 when this law will take full effect.

According to the law, there are several qualifying conditions like ALS, HIV/AIDS, cancer, multiple sclerosis, PTSD, severe pain, neuropathies, intractable seizures, Crohn’s disease, sickle cell anemia, spinal cord damage, Huntington’s disease, epilepsy, or other terminal illness. Home cultivation is not allowed, and there will be state-licensed dispensaries that will distribute the cannabis-infused products, and patients are proposed to possess a 30-day supply.

No Weed for West Virginians

If you are caught in possession of any amount of weed in West Virginia, you will get a misdemeanor penalty and a minimum of 90 days up to a 6-month stay in prison and $1,000 fine. Marijuana is considered a Schedule I drug, meaning that anyone caught dealing weed here can get from 1 to 5 years in prison, a felony charge, and a $15,000 fine.

To make things easier for people, anyone caught in possession of fewer than 15 grams of weed will be conditionally discharged and put on probation.

The state does not allow recreational use of weed, but there is a conditional release for anyone caught with 15 grams or less for the first time. Lastly, CBD is not banned, meaning that it is legal to use CBD products in West Virginia as long as these are in compliance with the US federal law – hemp-derived CBD with less than 0.3% THC is legal to use throughout the entire country.
