Montana has allowed the cultivation of industrial hemp in 2001 by the passing of Senate Bill 261, and it has defined hemp as containing less than 0.3% THC, deeming it an agricultural crop. The state issues licenses for farmers that want to cultivate hemp, under the Industrial Hemp Pilot Program governed by the Montana Department of Agriculture. The only stipulation is that farmers need to procure seeds from a DEA-approved seed source.

The state does not regulate CBD production or sales. Instead, under the US Farm Bill, it is legal for CBD oil and other CBD products to be sold in the USA, as long as these contain less than 0.3% THC and are derived from hemp.

Medical marijuana

The State of Montana has allowed the use of marijuana for medicinal purposes in 2004. Back then, only patients with severe epileptic seizures and other debilitating medical conditions could use medical marijuana, only with the recommendation from multiple physicians. But in 2016 this law was amended, and it is now much easier for patients to get registered and use medical marijuana.

Today the Montana Medical Marijuana Law includes patients with conditions like cancer, glaucoma, muscle spasms, intractable nausea, epilepsy, PTSD, painful peripheral neuropathy, Crohn’s disease, HIV/AIDS, and more. The patients can possess up to one ounce of usable marijuana and can grow four mature plants and four seedlings. Today there are over 32,000 registered medical marijuana users in Montana, and this program is governed by the Montana Department of Public Health and Human Services.

As per the Senate Bill 333 signed in May 2017, the medical cannabis industry is required to perform mandatory testing and “seed to sale” tracking policy. From July 1, 2018, the state has a 2% tax on medical cannabis, which translates to enormous income for the state.

No Weed Fun For Montanans

Weed is still illegal in Montana, and it looks like it will be a while before this state allows the recreational use of marijuana. The Last Best Place is not a place to light up a blunt, as anyone caught with up to 60 grams of weed will get a 6-month stay in prison and a $500 fine. Anything more and it is up to 5 years and $50K fine.
