California and CBD Oil Laws

Overview: Cutting straight to the point, CBD oil is legal to purchase and use in California. It has been on the way towards legalization since 2013, with the California Industrial Hemp Farming Act, and officially became legal in 2018. However, the use of marijuana for medical purposes has been legal since 1996, and marijuana for recreational purposes became legal in 2018.

California CBD Oil: Golden State Laws

California has been at the forefront of innovation in many fields, and that includes the marijuana and CBD industries. It is the first state that has legalized the use of marijuana for medical purposes, with the passing of the Compassionate Use Act of 1996. It was in 2013 that the production of hemp and hemp-based products would be on the way to become legal in California, with changes made with the Senate Bill 1409 taking full effect in 2018.

CBD Basics

CBD (cannabidiol) is one of about 113 phytocannabinoid compounds found in the Cannabis Sativa plant. Unlike the most famous cannabinoid – THC, which has strong psychoactive properties, CBD does not cause any psychoactive effects, but it brings a lot of beneficial medical effects and it can counteract the effects of THC.

The CBD has advantageous effects on pain management, inflammation, anxiety, mood swings, glaucoma, nausea, arthritis, and other serious conditions like seizures, migraines, cancer, PTSD, HIV/AIDS, Alzheimer’s and more. The variety of cannabis plants that produce a lot of THC are called marijuana, while the CBD-rich varieties are called hemp, and these are used for producing this amazing compound.

Two of the most famous CBD-rich strains that are favored by medical marijuana users are the Cannatonic and the ACDC strain.

  • Cannatonic is a strain that produces about 6% THC and an amazing 17% CBD, making it ideal for patients suffering from pain, muscle spasms, migraines, nausea, and anxiety.
  • ACDC has about 1% THC and can peak at 20% CBD. It is mostly used by patients with severe conditions like cancer, seizures, severe pain, persistent nausea, and even alcoholism.

California CBD laws and regulations

It seems pretty cynical, but Californians have gone all wrong in legalizing the use of marijuana and industrial hemp. The first thing Californians did was legalize marijuana for medicinal purposes, then legalized marijuana for recreational purposes and only then did they fully legalize the production of industrial hemp.

According to the California Department of Food and Agriculture’s Health and Safety Code, the definition of industrial hemp is a crop that is limited to types of the Cannabis Sativa plant, with no more than 0.3% THC in its usable parts and derivates. Also, it is legal to cultivate hemp in California, but growers need to be registered.

Medical and recreational marijuana in California

As I explained above, the medical use of marijuana is legal in California since 1996, but back then, people needed to have state-issued medical marijuana cards and needed a prescription from a licensed physician.

In 2016, the Adult Use of Marijuana Act was passed, effectively becoming law in November 2016 and taking effect in January 2018, legalizing the sale and use of marijuana for recreational purposes. Since then, California has become the largest market for marijuana in the USA, with market projections that the weed market will reach $5.5 billion by 2020.

CBD Oil Buying Options for Californians

As of 2018, it is completely legal to buy and use CBD oil the Golden State. There are a lot of licensed dispensaries selling all kinds o marijuana and hemp products, but unfortunately, there are also a lot of “gray area” stores.

In order to be completely certain that you are buying the best for you, you need to be certain that you are buying products from established manufacturers and certified sellers. The best sources for high-quality CBD oils and other CBD products often perform laboratory tests and readily publish their findings online for anyone to see.

While you are there checking the lab test results, you can make an online purchase as an added convenience, and have any type of CBD product (and it can contain THC) delivered to your home, often with free delivery.

The initial efforts for legalizing industrial hemp and its products in California first began in 2013, but failed in 2016, and were resurrected in 2018, making it completely legal to grow, cultivate and process industrial hemp, as well as manufacture and use CBD products derived from hemp.

Add to this the lift of any ban on marijuana use for recreational purposes that took effect on January 1st, 2018, California is now the US state with the loosest laws related to the use of marijuana and hemp products.

With the emergence of many local retail stores, some with a questionable background, the safest and most convenient option for Californians to obtain high-quality CBD products is to purchase them online. Start with the Medterra brand and I’m sure you’ll find something that fits your needs.
