CBD is being used by plenty of people from different professions, and plenty have found great relief from daily pains and aches. Because CBD is strongly related to marijuana, people have difficulties grasping the concept that CBD-based products are legal and are not psychoactive.

Still, one can’t help but wonder is CBD okay to be used by people that have difficult daily tasks like operating heavy machinery? There is no universal answer, so here we’ll take a closer look into this as explain whether or not truck drivers can use CBD freely. But first…

A Short Intro To Cannabidiol

Cannabidiol or CBD is a compound naturally occurring in the hemp and marijuana plants. This compound is different from the more famous THC or tetrahydrocannabinol as it does not have any psychoactive effects. Instead, it has been linked to having an array of health benefits. And this is not just hearsay, as plenty of scientific research has substantiated these claims.

The impressive thing about CBD is that it can help the body restore its natural balance. CBD stimulates specific receptors in the body, activating them and boosting all systems. Thus, it can help with plenty of concerns, and some of these are quite unexpected.

People have had great success using CBD for mild pain, chronic pain, anxiety, arthritis, sleep issues, and some more serious issues like PTSD, depression, epilepsy, and more.

So, it should come as no surprise that plenty of people would give CBD a try. CBD can boost the immune system and stave off inflammation. This property of CBD is what tips the scales in its favor, as plenty of people that have to sit on their behinds all day often have chronic pain, inflammation issues, and even nerve pain.

Yes, that involves people that work in different environments and require the relief CBD can provide. What does this mean for the heavy machine operating guys?

The ones that have to sit in a truck cab for days, hauling heavy loads across the country? Do they risk their licenses if they give CBD a go? Read on to find out.

State & Federal Laws Related To CBD

Let’s start with the federal laws related to CBD. On a federal level, any CBD product that is derived from industrial hemp and has less than 0.3% THC is considered legal and safe to use.

This is almost all the CBD products on the market today, as all respectable CBD companies use industrial hemp for their CBD, and follow federal regulations.

Still, here we need to note the subtle differences from one state to the next. There are (so far) 11 US states that have fully legalized the use of marijuana. In total, 33 US states have laws related to medical marijuana use. But all 50 US states have allowed CBD use.

Why do we mention this? Because truck drivers cross states lines often, sometimes on the same day, and they could inadvertently break state law. For more info on state laws regarding CBD use, follow our state by state guide.

The Department of Transport has issued a drug and alcohol compliance test requiring truck drivers and other safety-sensitive workers (commercial pilots, bus drivers, locomotive operators, and the like) to have regular tests for alcohol and drug abuse. Since CBD is a legal substance, the DOT test does not look for CBD, but it looks for THC since THC is the psychoactive substance.

Can Truck Drivers Use Products Containing?

A simple answer, yes they can. But the more detailed answer is that they need to be careful what type of CBD product they are using. Since all the US states have different state laws related to the use of CBD, truck drivers need to be aware of the ingredients in their CBD products.

For example, full-spectrum CBD products have a small amount of THC, which is less than 0.3%. This amount is small but is still present. While one dose will not show on any standard drug test, prolonged use of full-spectrum CBD products can indeed cause a positive result on a drug test. We need to note here that using a higher daily dose of full-spectrum CBD products increases the chances of getting a positive result.

The other types of CBD products are broad-spectrum and CBD isolate products. These are rated as having zero THC in them. Anyone using these has a bigger chance of testing negative for THC on a standard drug test as they are not getting any THC at all with their daily dose of CBD.

Still, there is also the risk of getting a false positive on your drug test, even if you use pure CBD products. This is due to the way each body metabolizes the CBD product, which varies significantly.

But because CBD and THC are fat-soluble molecules, these can accumulate in the fat-storing cells in the body. As the fat tissues melt, the THC stored there gets released and it can amount to such quantities that will test positive.

How Can Truckers Safely Use CBD Products?

While we tackled the basic concerns related to CBD product use with truck drivers, here we’ll also provide extra information that would be useful for truckers and other safety-sensitive employees. If you are subjected to a random drug test, then it is in your best interest to disclose that you are using CBD oil before the test.

You should also explain why you use the CBD oil for, and if possible provide the actual product. This way, even if you do end up testing positive due to the amount of THC in the CBD oil, you are covered and have better chances of retaining your license.

To be certain that the CBD product you are using is of quality, stay away from the cheap stuff sold almost everywhere. By getting a CBD product from a respectable source, you are not only getting a product that works, but you are also getting a product that is lab tested.

Trusted CBD companies post the up to date results online, and these correspond to the actual product you are using. This way, if you are subjected to a drug test, you can provide the lab test results from the actual CBD product you are using, just to be on the safe side.

Another important thing for truck drivers – the different states have different laws on what is considered possession. While most are very forgiving on finding CBD products in a truck, there are several states where it is considered an offense to have any type of CBD product in your truck cab.

These states are South Dakota, Idaho, and Nebraska. All other US states do not have issues with finding CBD oil with truck drivers, so consider yourself informed.

CBD use is legal on a federal level, but its use by commercial vehicle drivers is sometimes frowned upon. So, to help out, we prepared these important things truck and CVM drivers need to know:

If using CBD oil or any other type of CBD product, immediately inform your employer, as this may save your job.

If you get asked for a random drug test, inform the authorities before the test that you are using CBD products. It is preferable to provide the actual product and lab tests for your particular product.

If you know you’re going to be tested, some people do choose to incorporate the Jerry G method into their daily routine before the testing day.

Abstain from CBD use, and possessing any type of CBD product when driving through South Dakota, Nebraska, and Idaho. These states have unforgiving laws related to CBD use and you can lose your license and job if you get pulled over with a CBD product in your truck.

Use CBD oil and other CBD products only from respectable manufacturers. These products have better components and bring better effects while respecting the legally-prescribed limits of less than 0.3% THC per weight. Also, respectable brands always test their products and publish the results online.

Prefer broad-spectrum CBD or CBD isolate products, as these have way less THC content than full-spectrum CBD products. While there is a small chance of testing positive by using a full-spectrum CBD product, you can increase your shot of testing negative if you use CBD isolate products.

Use a smaller dose of CBD products. Some people can get drowsy when using a higher dose of CBD. As a truck driver or other CMV driver, you should abstain from using CBD products while you drive, and use a lower dose of CBD during your off-hours.

Final Thoughts – Drive Safe With CBD

While the benefits of CBD are becoming undisputable, there are some risks involved with the use of CBD products. The major risk for truck drivers and other safety-sensitive workers is testing positive on a random drug test. The DOT drug test is nothing to joke about.

Still, as we noted above there are ways to protect your CMV license, so make sure you follow these and learn plenty about this topic. Advise with a medical professional before you start a CBD product regimen, and learn the state CBD laws in every state you are driving in.

The first legalization of industrial hemp in the State of New York was in 2014, and later expanded allowing commercial cultivation in 2015. This state allows the use of marijuana…

The first legalization of industrial hemp in the State of New York was in 2014, and later expanded allowing commercial cultivation in 2015. This state allows the use of marijuana for medicinal applications since 2014. There is no law preventing the use of CBD products, and every New Yorker can freely use any type of CBD product they like, as long as it complies with federal regulations.

CBD in the Empire State

In 2014, the New York legislators voted on a law allowing the cultivation of industrial hemp for research purposes by higher educational institutions, in order to gather information about the viability of commercial cultivation of hemp. The institutions growing hemp need to have state licenses by the Department of Agriculture & Markets.

There is no law preventing the use of CBD oil or other CBD products in New York. But this state has somewhat strict policies regarding the use of medical marijuana and not so liberal view towards anything cannabis-related.

Hemp and CBD

The cannabis plant produces a lot of compounds, among which, there are 113 cannabinoids. The most famous one is THC, which is the main product from the variety of cannabis known as marijuana. The second most famous one and the one with the highest beneficial effects is CBD and is the main product of the variety known as hemp.

Hemp has a variety of other uses like the production of fiber, cloth and rope, paper, insulation, biofuel, animal feed, animal bedding, and a lot more. It is far simpler to grow than marijuana and grows very well in a variety of climates and humidity levels.

The CBD molecule has multiple roles in the human body, as it binds with the receptors in the endocannabinoid system, helping the body restore its natural balance, manage pain and deal with stress and other disorders.

There are many strains of cannabis, and when I say many, I mean great many. There are strains with high THC contents, strains with high CBD contents and all of these have unorthodox names. In honor of New York, here are two strains named after this state (or most likely NYC).

New York Power Diesel or NYPD is a strain that comes from a mixed heritage and packs a good punch. It is predominantly THC-rich strain, with uplifting, slightly euphoric and happy effects that can make anyone feel relaxed and even giggly. The medical side of this strain is aimed at helping with stress, depression, fatigue, and fighting inflammation.

NY Cheese is a good strain, with a familiar cheese-like smell with diesel undertones. The effects are fast, with excellent energizing properties, but also effective in bringing the creative juices and inspiring euphoric feelings. The medical effects are good and help with migraines, pain management, depression, and arthritic pains.

New York CBD oil law

The State of New York allowed the cultivation of industrial hemp in 2014, with the signing of Senate Bill S7047, establishing an agricultural pilot program. This program is now active, with ten sites authorized to cultivate industrial hemp.

The state does not forbid the use of CBD oil or any other CBD product as long as it has less than 0.3% THC. So anyone interested in getting CBD products in this state can do it freely, with no fear of breaking any laws.

Medical Mary Jane

The people of the state of New York can freely take marijuana for medicinal applications since 2014. The law allowing this is aptly called the Compassionate Care Act and is currently serving close to 100,000 patients.

In order to qualify, the patients need to have one of the qualifying conditions such as PTSD, epilepsy, cancer, chronic pain, HIV/AIDS, Parkinson’s disease, ALS, IBD, Huntington’s disease, multiple sclerosis, neuropathy, spinal cord injury or opioid substitution. The state has a strict policy regarding medical marijuana use, and the dispensary system is very restrictive, with only 40 dispensaries in the whole state.

The patients are not allowed home cultivation of marijuana, but they can have up to 30 day supply of cannabis-infused, non-smokable products. Today, the medical marijuana program is run by the New Your State Department of Health.

No “Weed” For New York Folk

Even though the possession of small amounts of weed is decriminalized in the State of New York and people caught with 25 grams or less will only get a $100 fine ($200 for a second offense), it is still illegal to smoke weed here.

The state does not allow the public consumption of weed and is classifying it as Schedule I hallucinogenic substance. Also, anyone caught growing any number of marijuana plants will get a year in prison and $1,000 fine.

CBD Purchase Options

Aside from the 40 state-licensed dispensaries, there are many other retail stores that carry good CBD products. Many are located in New York City, which is the most densely populated area in the state. There are also good CBD shops in Albany, Syracuse, Buffalo, and others.

For anyone that does not like to go out and get their CBD products, there is always the online order. This way people can make sure they are getting the product from a reputable seller and have it delivered to their home.

Conclusion

With Senate Bill 7047, the State of New York has allowed the establishment of an industrial hemp research program in order to help farmers that want to go into commercial hemp cultivation. This state has a medical marijuana program installed since 2014, with a very restrictive prescription and dispensary system. Due to the complicated system, the state has decided to loosen up some aspects, making it easier for the almost 100K people to find relief in medical cannabis.

New York does not allow the use of marijuana for recreational purposes but has decriminalized the possession of small amounts of weed. At last, the use of CBD products in this state is completely legal as long as they are derived from industrial hemp and have less than 0.3% THC.

The North Dakota lawmakers have allowed the cultivation of industrial hemp with an Industrial Hemp Research Pilot Program, and in 2015 it was allowed for farmers to grow industrial hemp…

The North Dakota lawmakers have allowed the cultivation of industrial hemp with an Industrial Hemp Research Pilot Program, and in 2015 it was allowed for farmers to grow industrial hemp with facilitated licensing programs. The state has a medical marijuana program enacted, with a long list of qualifying conditions. Also, the use of CBD oil in North Dakota is free for all citizens, as long as the CBD products comply with US federal laws.

CBD in the Peace Garden State

North Dakota has allowed the cultivation of industrial hemp for research purposes, and people were allowed to cultivate this crop with a strict license since 1999. This pilot program was governed by the Department of Agriculture and required extensive application processes and fees. Later, in 2015, this law was expanded and the licensing process was facilitated, and now farmers can easily procure hemp-growing licenses. There is only the provision that these licenses need to be approved by the DEA.

CBD Production

The industrial hemp crops in the USA are mainly planted for the production of CBD; all the other applications are secondary. Once the hemp is planted it takes about four months for it to mature and be ready for harvesting. After the harvesting, the plant material is prepared for the extraction of the CBD.

This can be done in two main ways: CO2 extraction and ethanol extraction. The CO2 extraction process uses carbon dioxide and is performed at lower temperatures, which don’t affect the quality of the extract. CO2 extraction does not use additional solvents which can contaminate the extracts. It is a very effective process, and it yields excellent results, successfully separating the lipid CBD from the plant material.

The ethanol extraction process uses ethanol as a solvent, which dissolves the lipid CBD, transferring it from the solid plant material into the liquid solvent. This mixture is then boiled at low temperatures, the ethanol dissolves and what is left is pure hemp extract rich in CBD. No matter the extraction process, the obtained CBD extract is pure and solvent-free, as both of these processes are used in food production.

Hemp and cannabis come in a large variety of strains, many high in THC and many high in CBD. Here I bring you an outline of two predominantly CBD-rich strains that are favored among the medical cannabis community.

Medical 49 is a strain that has about 6% CBD and 7% THC and is a very favorite strain among medical marijuana users across the world. It has a mixed heritage which shows in its unusual terpene profile. It has a lemony, piney and earthy fragrance and leaves an earthy, woodsy, citrusy aftertaste in the mouth. The Medical 49 is indica-dominant, with mainly relaxing and sleepy effects, while helping fix insomnia, providing relief from cramps, and helps with depression, pain, and headaches.

Jamaican Lion is a strain that is a mix between several interesting strains, giving this one a truly amazing terpene profile. The buds smell of flowers, earth, herbs, and sweetness and taste sweet, nutty, with a tropical aftertaste. The initial effect is uplifting, followed by a relaxed, happy feeling. The medical side is strong, with excellent pain and stress relieving properties, helping with muscle spasms, and depression.

North Dakota CBD Oil Law

The State of North Dakota has an Industrial Hemp Research Pilot Program in order to study the viability of cultivation of this crop. The initial program was established in 1999, and in 2015 it was expanded into a complete cultivation program with 27 licensed producers.

This program does not include or restrict the use of CBD products of any type in the Sioux State. As long as the CBD oil and other CBD products comply with the US federal laws and have less than 0.3% THC and are derived from hemp, these are legal to use in the whole US.

Medical MJ

North Dakota has installed a medical marijuana program in 2016, and the first dispensaries began offering medical cannabis on March 1st, 2019. The qualifying conditions list is relatively long and includes several diseases and syndromes that aren’t included in the other US States with medical marijuana programs. Some of these conditions include autism, bulimia, cancer, ALS, nausea, multiple sclerosis, PTSD, seizures, and more.

The possession limit is three ounces for a thirty day period. The initial law allowed the home cultivation, but this was amended in 2017 with Senate Bill 2344. The Medical Marijuana Program is governed by the North Dakota Department of Health.

Weed Not Allowed In North Dakota

Possession of very small amounts of weed or less than ½ ounces in the Peace Garden State is only punishable by a monetary fine of $1000. Anything up to 500 grams it is 30 days in jail and over this amount or a second offense and it is 1 to 10 years in prison and $3000 to $20,000 fine.

These laws were far stricter and a simple joint could land someone in jail for a month, but the new Governor eased these laws, basically decriminalizing the possession of half an ounce of weed. This is not exactly legalizing weed, but it is a start, seeing as Canada next door has full-on legalization of weed.

Buyer Options

The CBD market is not as evolved in North Dakota as it is in other US states. That is why it is rare to find good retail stores that carry high-quality CBD products. There are several shops in Fargo and Bismarck, but not in many other cities across the state.

The best option for the North Dakotan citizens that are in need of good CBD products is to order it online. The important thing they need to look out for is that the CBD products need to comply with the US federal laws and derive from hemp and have less than 0.3% THC.

Conclusion

This state has an Industrial Hemp Research Pilot Program and it is currently employing 27 cultivators. The production of industrial hemp here is mostly for the production of CBD, which is not banned for use in the Rough Rider State. However, the state legislators saw the benefits many people suffering from debilitating conditions can reap from medical cannabis, which is why they installed a Medical Marijuana Program, currently serving 658 patients, seeing as the program is operational for only a few months.

The use of cannabis for recreational purposes is not allowed, but the possession of small amounts of weed is only fined with a monetary fine. Be careful, as a repeating offense will land anyone in prison. Lastly, the use of CBD oil and other CBD products in North Dakota is free for anyone, as long as these have less than 0.3% THC.

Overview: The State of Montana has legalized industrial hemp as an agricultural crop in 2001, removing it from the list of controlled substances, as long as it has less than…

Overview: The State of Montana has legalized industrial hemp as an agricultural crop in 2001, removing it from the list of controlled substances, as long as it has less than 0.3% THC. Later in 2004, this state allowed the use of cannabis for medicinal purposes, but this law was re-voted in 2016, taking full effect in 2017.

CBD oil in the Treasure State

The use of CBD oil in Montana is not regulated with any state law, so its use is legal and free under the US Federal Farm Bill of 2018. This state has allowed the cultivation and processing of hemp in 2001, and with a state-licensing program, farmers are allowed to commercially grow industrial hemp.

This law states that the industrial hemp should contain less than 0.3% THC, which coincides with the federal regulations, to the satisfaction of many. Montana has first allowed the use of cannabis in 2004, but only for patients with severe medical conditions. It was twelve years later, in 2016 when this law was fully actually implemented, with expanded criteria and simplified prescription processes.

CBD – A Great Choice

CBD is short for cannabidiol, one of 113 identified cannabinoids naturally occurring in the cannabis plants. CBD has no psychoactive properties, but it has great beneficial effects on many health concerns. It helps the body’s ability to fight inflammation, helps with pain management, relieves epileptic seizures, helps with mood disorders, PTSD, stress, anxiety, nausea and more.

It binds with the CB (CB1 and CBD2) receptors in the endocannabinoid system in the body, positively affecting the wellbeing of the body. CBD also helps the cognitive functions, helping normalize endocrine functions, and is helpful with ocular pressure, and increases the immune response and has anti-tumor effects.

There are many varieties of cannabis, some that produce a high THC content and some that have a high CBD content. The latter is used by people medicating with cannabis, and here I present two famous CBD-rich strains.

CBD Shark will not come back to bite you but will put you in a relaxed state, due to the powerful indica-dominant terpene profile. The high CBD content in this strain is around 10%, making it very useful when dealing with pain, inflammation, fatigue, and stress. The CBD Shark has a softer smoke, with piney, earthy and minty flavors.

Harlequin GDP is a CBD-rich strain with a 3:1 CBD vs. THC ratio. It is a hybrid, with strong influences from its mixed heritage. It relaxes the body, stimulating the mind, and not putting it into a couch-lock state. The medicinal side of this strain is very strong, with emphasis on stress relief, pain and inflammation relief, help with nausea and depression.

Montana CBD Oil Law

Montana has allowed the cultivation of industrial hemp in 2001 by the passing of Senate Bill 261, and it has defined hemp as containing less than 0.3% THC, deeming it an agricultural crop. The state issues licenses for farmers that want to cultivate hemp, under the Industrial Hemp Pilot Program governed by the Montana Department of Agriculture. The only stipulation is that farmers need to procure seeds from a DEA-approved seed source.

The state does not regulate CBD production or sales. Instead, under the US Farm Bill, it is legal for CBD oil and other CBD products to be sold in the USA, as long as these contain less than 0.3% THC and are derived from hemp.

Medical marijuana

The State of Montana has allowed the use of marijuana for medicinal purposes in 2004. Back then, only patients with severe epileptic seizures and other debilitating medical conditions could use medical marijuana, only with the recommendation from multiple physicians. But in 2016 this law was amended, and it is now much easier for patients to get registered and use medical marijuana.

Today the Montana Medical Marijuana Law includes patients with conditions like cancer, glaucoma, muscle spasms, intractable nausea, epilepsy, PTSD, painful peripheral neuropathy, Crohn’s disease, HIV/AIDS, and more. The patients can possess up to one ounce of usable marijuana and can grow four mature plants and four seedlings. Today there are over 32,000 registered medical marijuana users in Montana, and this program is governed by the Montana Department of Public Health and Human Services.

As per the Senate Bill 333 signed in May 2017, the medical cannabis industry is required to perform mandatory testing and “seed to sale” tracking policy. From July 1, 2018, the state has a 2% tax on medical cannabis, which translates to enormous income for the state.

No Weed Fun For Montanans

Weed is still illegal in Montana, and it looks like it will be a while before this state allows the recreational use of marijuana. The Last Best Place is not a place to light up a blunt, as anyone caught with up to 60 grams of weed will get a 6-month stay in prison and a $500 fine. Anything more and it is up to 5 years and $50K fine.

CBD Buyers Info

The Montana laws don’t have anything against using CBD oil or other CBD products. That is why there are CBD retail stores all across the state, with the best ones located in larger cities like Bozeman, Billings, and Missoula.

Since the internet is such an amazing place and anything can be found here, people often turn to online sources for getting stuff they need. The same goes for CBD. Selecting the CBD brand and type of product they need, with just a few clicks people will have it right at their doorstep.

To Wrap It Up

Montana has allowed the cultivation of industrial hemp in 2001 and in 2004 has allowed the use of marijuana for medicinal purposes. The state issues licenses for the farmers that want to grow hemp, requesting they purchase the seeds from DEA-approved seed suppliers.

The medical marijuana laws were expanded and now it is much simpler for patients in need to get registered and get a medical marijuana prescription. The Big Sky Country does not allow the use of marijuana for recreational purposes, and any possession of weed is punishable with a jail sentence and a hefty fine.

Seeing as CBD is not banned by any state law, it is legal to use across the entire state, as long as it derived from hemp and has less than 0.3% THC, as the Federal Farm Bill states. Montanans have CBD retail stores in the bigger cities, but still, the best option for people to get good quality CBD oils and other CBD products are online.

North Carolina has a very strict policy regarding the use of cannabis-derived products. There is an industrial hemp pilot program in place that conducts research and is governed by the North Carolina Industrial Hemp Commission. This state allows people with severe epilepsy to use high-CBD products, but no other medical cannabis use.

CBD in the Tar Heel State

The cultivation of industrial hemp is currently in the research phase, as North Carolina has allowed this in 2015 with Senate Bill 313. This program is run by an Industrial Hemp Commission and they work together with North Carolina State University and the North Carolina A&T State University to estimate the viability of the commercial growing of hemp.

Hemp and US history

Hemp was cultivated thousands of years ago. That’s when it got started, when people used this plant to produce fiber, rope, and cloth. Later people found out that hemp has some very beneficial health effects, and the seeds can also be used as food.

The first European settlers in the USA brought hemp with them in the early 1600s, planting this amazing plant and beginning a new chapter in the hemp cultivation. It was grown in many colonies, and back then it was required by law for many people to grow hemp. Some of the founding fathers even grew hemp as a cash crop.

The banning of marijuana took industrial hemp along with it, and it was in 1940 when the major hemp farms were destroyed, with a small surge during the Second World War and came to a complete stop in 1957. Much later, in 2014, the US Federal Farm Bill put hemp on the list of agricultural crops, making it legal for people to grow this plant on US soil.

Among the many uses of hemp, the main one is the production of CBD. There are varieties high in CBD and varieties high in THC. Here I bring you two CBD-rich strains.

Doctor Doctor is a strong sativa-dominant strain that has a very high CBD content, going up to 20%, with THC content near 1-3%. Due to the chemistry of CBD and its effect on THC, this strain is considered almost THC-free and is favored by medical cannabis users. Smelling of strawberries, lemons, and lavender, its main effects are uplifting, clear and invigorating. The medical effects are pain and stress relief, helping with inflammation and nausea and relieving seizures and muscle spasms.

Refael is another almost THC-free strain developed for its strong uplifting effects and great medical benefits. The buds smell and taste of moss, pines, and herbs, and have good effects on the mood, uplifting the spirit, bringing happiness and energizing the body. The medical side is what Refael is most used for, as it helps control pain, relieves seizures, muscle spasms, nausea, and stress.

North Carolina CBD Oil Law

The growing of hemp resumed in North Carolina in 2017, even though the law was signed in 2015. The state allows research regarding industrial hemp and is governed by an Industrial Hemp Commission along with state universities.

The state does not have a ban against the use of CBD products as long as these comply with the Federal Farm Bill and contain less than 0.3% THC and are derived from hemp.

Marijuana

The North Carolina legislation body allows the use of CBD-specific marijuana products only for people suffering from severe intractable epilepsy. This law was signed in 2014 and it prescribes the use of cannabis extracts with less than 0.9% THC and more than 5% CBD. There is no home cultivation allowed and there are no state-licensed dispensaries in North Carolina, meaning that people in need of this product can’t obtain it through simple (or any kind of) means.

In March 2019, the House of Representatives in North Carolina proposed a bill called the Medical Cannabis Act (if and when legal), protecting patients with debilitating medical conditions against drug-related prosecution. This bill would also expand the qualifying conditions of medical marijuana use and would make it legal for people in need to obtain medical marijuana in North Carolina.

No weed for North Carolinians

In view of the strict laws related to medical cannabis use, it is somewhat unexpected that this state has decriminalized the possession of small amounts of weed for personal use. Anyone caught with 0.5 ounces of weed or less will only get a $200 fine in the First in Freedom State.

Anything more than 1.5 ounces and it is about 8 months in prison and $1K fine. Marijuana is considered a Schedule VI substance in North Carolina, and it is illegal to use. With the talks in early 2019, it seems like many people in this state are looking forward to changing this law and loosening the grip around the recreational use of weed.

CBD purchase options

Since this state does not ban the use of CBD oil or other CBD products that are in compliance with federal laws, there are many retail shops that carry good quality CBD products in North Carolina. There are good shopping options in Raleigh, Charlotte, Wilmington, Asheville, Conover and more.

For the people that live too far or want to buy CBD products in a discreet manner, there is always the online order. The federal law allows CBD products with less than 0.3% THC and most respectable sellers post lab test results and certificates of authenticity online, so anyone can check their credentials. Plus, there is usually free delivery.

Last Thoughts

The State of North Carolina has a long history of cultivating hemp; hemp was grown here since colonial times. This tradition was resumed in 2017, with laws allowing the cultivation of hemp in 2015. The North Carolinian legislative body only allows the use of CBD-specific marijuana products with up to 0.9% THC and more than 5% CBD for people with severe epilepsy.

There are talks and propositions of expanding the medical marijuana law, allowing the use of cannabis for several debilitating medical conditions. North Carolina does not allow the legal use of marijuana, but it has decriminalized possession of small amounts of weed. Lastly, under the US Federal laws, it is legal for every US citizen to purchase hemp-derived CBD oil as long as it has

The State of Oklahoma allowed the cultivation of industrial hemp for research and development purposes with House Bill 2913 passed in 2018. There is a CBD-specific law and a medical marijuana law it this state, and the use of hemp-derived CBD products is free for all Oklahoma citizens.

CBD in the Sooner State

Oklahoman lawmakers allowed the cultivation of industrial hemp with the voting of the Oklahoma Industrial Hemp Agricultural Pilot Program Act, allowing farmers and universities to work together, planting certified low-THC seeds for research and development purposes. This law was passed in 2018, and since then, there has been an enormous interest with Oklahoman farmers for growing this crop. For anyone interested more in the industrial hemp policies and obtaining a license, you can find more information here.

Oklahoma Hemp and CBD – Overview

The cannabis plant comes in two main varieties: marijuana and hemp. Marijuana produces large quantities of the compound known as THC or tetrahydrocannabinol. This compound has psychotropic effects and is on the DEA’s list of banned or controlled substances. Also, marijuana plants require special attention and cannot thrive in various conditions.

The hemp variety of cannabis is not producing a lot of THC, but it producing a lot of another compound – CBD or cannabidiol. CBD does not have any psychotropic effects on the mind, but it has beneficial effects on the health of the people. Also, hemp can be grown without any hassle in a variety of conditions, as it thrives equally well in Alaska and Oklahoma.

The marijuana and industrial hemp are the two ends of the spectrum, and there are large varieties of strain that are in-between, with varying CBD and THC quantities, favored by the medical users of cannabis. Here I bring you two such strains.

The Wife is a CBD-rich hybrid strain that usually produces THC vs. CBD ratio of 1:20. This strain smells of cherries, flowers, and earthiness, and leaves a cherry taste in the mouth. The initial effects are mainly relaxing, with a happy, uplifting, euphoric high. The medical side is also very strong, with stress-relieving properties, helping with headaches, pain, and inflammation. This strain is very useful with people suffering from nausea caused by chemotherapy, as it soothes nausea and helps with the lack of appetite.

Cherry Wine is a hybrid strain descendant from the Wife, and as such, it has many properties from its parent like the high CBD content ranging from 16 to 25%. It has a sweet cherry aroma with hints of spices. The flavors it leaves are of sweetness and berries. This strain has a nice subtle euphoric high, promoting increased focus and happy feelings, while the medical side is mainly aimed at pain relief, helping with stress and depression, as well as nausea and inflammation.

Oklahoma CBD oil law

Apart from the Industrial Hemp Agricultural Pilot Program Act, the state of Oklahoma does not have any restrictions on the use of CBD products specified under the federal laws. The State of Oklahoma has a CBD-specific marijuana law, allowing the use of lipid preparations containing CBD and derived from seeds or mature stalks of hemp, as long as these have less than 0.3% THC. These can be used in cases of pediatric epilepsy and the law was passed in 2015.

Medical marijuana

In May of 2018, Oklahoma legislators passed a law related to the use of marijuana for medicinal purposes. There are no specified qualifying conditions, but the patients need to have a prescription from their treating physician. Once a patient has issued a medical marijuana card in Oklahoma, they can legally possess up to three ounces of marijuana on them and grow up to six mature plants at home.

The use of medical marijuana in Oklahoma is regulated by the Oklahoma Medical Marijuana Authority where interested parties can find everything related to the use of medical marijuana in this state. Currently, there are about 68,500 registered patients in Oklahoma that get their medical marijuana from about 1040 licensed dispensaries.

No Weed for Oklahomans

The Land of the Red Man is not a land where one can freely light up the peace pipe, as any possession of marijuana is punishable by a year in prison and $1K fine. The law classifies marijuana as Schedule I drug, but it excludes the mature stalks and fiber produced from these, also the oil and cake made from the seeds of this plant, including the CBD derived from in.

Oklahoma City has decriminalized the possession of small amounts of weed and anyone caught here will only get a $400 fine and no jail time.

CBD purchase options

Since CBD products derived from industrial hemp and containing less than 0.3% THC are legal to use in Oklahoma, this state is noticing an emerging trend in popularity. There are many stores carrying good CBD products in Oklahoma, and most are concentrated in the bigger cities like Oklahoma City, Tulsa, Norman, and Stillwater. For anyone that lives too far away from the stores carrying CBD oils and other CBD products, there is always the option to order online.

Wrap Up

Oklahoma has established an industrial hemp pilot program for cultivating this crop for research purposes. Farmers need to cooperate with universities, get licenses and plant only licensed seeds that guarantee plants rich in CBD and poor with THC. This state has become the 30th US State to legalize medical cannabis use in 2018. The good news is that there are no specified qualifying conditions, but people get recommendations and prescriptions from their treating physician.

The Sooner State does not allow its citizens the free use of marijuana for recreational purposes, but some parts of it, like Oklahoma City, have decriminalized the possession of small amounts of weed. Lastly, CBD is completely legal to use in Oklahoma, as long as it is derived from industrial hemp and has less than 0.3% THC.

TL;DR: The North Dakota lawmakers have allowed the cultivation of industrial hemp with an Industrial Hemp Research Pilot Program, and in 2015 it was allowed for farmers to grow industrial hemp with facilitated licensing programs.

Medical marijuana

North Dakota has installed a medical marijuana program in 2016, and the first dispensaries began offering medical cannabis on March 1st, 2019. The qualifying conditions list is relatively long and includes several diseases and syndromes that aren’t included in other US States with medical marijuana programs. Some of these conditions include autism, bulimia, cancer, ALS, nausea, multiple sclerosis, PTSD, seizures and more.

The possession limit is three ounces for a thirty day period. The initial law allowed the home cultivation, but this was amended in 2017 with Senate Bill 2344. The Medical Marijuana Program is governed by the North Dakota Department of Health.

No weed for North Dakotans

Possession of very small amounts of weed or less than ½ ounces in the Peace Garden State is only punishable by a monetary fine of $1000. Anything up to 500 grams is 30 days in jail and over this amount or a second offense and it is 1 to 10 years in prison and $3000 to $20,000 fine.

These laws were far stricter and a simple joint could land someone in jail for a month, but the new Governor eased these laws, basically decriminalizing the possession of half an ounce of weed. This is not exactly legalizing weed, but it is a start, seeing as Canada next door has full-on legalization of weed.

CBD purchase options

The State of South Carolina has enacted an industrial hemp law in 2014, allowing a licensed production of this crop by South Carolina farmers. This state has a CBD-specific medical…

The State of South Carolina has enacted an industrial hemp law in 2014, allowing a licensed production of this crop by South Carolina farmers. This state has a CBD-specific medical marijuana law also enacted in 2014, with only a few qualifying conditions. Other than this, South Carolina has a firm hold on the ban on cannabis-related products.

CBD in the Palmetto State

The initial talks of allowing the cultivation of industrial hemp in South Carolina began in 2007, but it was in 2014 when the state legislators separated the hemp and marijuana definitions, allowing the cultivation of hemp as an industrial crop. After amending and updating this law several times, in 2018 South Carolina farmers planted 256 acres of hemp for the first time.

CBD and CBD oil

CBD is an abbreviation for cannabidiol, one of 113 identified cannabinoids. These chemical compounds are naturally occurring in the cannabis plant and have a variety of effects. The most famous cannabinoid of all is THC, which has psychoactive properties and is illegal in large part of the world.

CBD or cannabidiol has strong beneficial medical effects and it helps with the reduction of inflammation, helps with depression, anxiety and stress relief, pain management, helps with eating disorders and nausea, and relieves the symptoms of PTSD and other conditions.

The cannabis plants come in a wide variety of strains with different terpene profiles and different amounts of THC and CBD. The THC-rich strains are known as marijuana; the CBD rich strains are known as industrial hemp. Here are two strains with good amounts of CBD and THC and with favorable medical benefits.

ACDC has a very low THC content ranging between 1 and 6%, and very high CBD content going up to 20%. Its buds smell earthy, sweet, and slightly skunky, with slight fruity hints. The flavors it leaves are interesting, with a spicy, fruity taste. This strain is very useful for medical marijuana users, as it helps with pain, nausea, anxiety, depression, and seizures.

Harmonia is a strain with higher CBD and lower THC levels, usually at 12% and 10% respectively. It smells earthy, herbal and fruity, and leaves a taste of sweet fruits, lemons, and pine sap. This strain is useful when dealing with muscle spasms, cramps, anxiety, stress, pain, and inflammation. Due to the high indica influence, this has a preferred nighttime use.

South Carolina CBD Oil Laws

The State of South Carolina has a law related to the cultivation of industrial hemp, but it has no law related to the free use of CBD products. Seeing as there are federal laws legalizing the use of CBD oil, as long as it is derived from industrial hemp and has less than 0.3% THC, we can only assume that this is legal to be used in this southern state.

But this is still a grey area with some undefined aspects, as the FDA does not allow the use of CBD for public use, and the US Federal Farm Bill of 2014 has allowed the use of CBD in the entire USA. Thus, South Carolinians can use CBD products as long as these comply with federal law.

Medical Marijuana

South Carolinian people can use medical marijuana only in the form of high CBD oil with a licensed physician’s recommendation. The CBD oil has to have at least 15% CBD and less than 0.9% THC. The patients need to have one of three qualifying conditions: Dravet syndrome, Lennox-Gastaut syndrome and refractory epilepsy.

The state does not have a dispensary system, and this is still an undefined field. However, there is a medical cannabis act known as the South Carolina Compassionate Care Act that is in consideration in the House of Representatives and should be voted on in late 2019.

Sorry, No Weed for South Carolina

The South Carolina laws don’t allow any type of use of marijuana. This means that there is no lighting a joint in South Carolina, but if you risk it and have less than an ounce of weed with you, then you face a 30-day stay in prison and a $200 fine. A second offense is a year in prison and $2K fine. Dealers face at least a five-year prison sentence and $5K fine.

CBD Buying Options

The people of South Carolina can get some good CBD products in several retail stores across the state. Some of these can be found in Charleston, Greenville, Mount Pleasant and Goose Creek. For the people that are far from the CBD retail stores, there is always the option to order online. By going online to order, people can select the best product for them and check the manufacturer’s credentials; not to mention, free delivery to your home.

Finishing thoughts

South Carolina has a law allowing the commercial cultivation of industrial hemp, and last year 256 acres of this crop were planted here. Also, there is no legal allowance of medical marijuana, but only high CBD oil for medicinal applications. There is no state registry or licensed dispensaries, but patients get recommendations from their physicians and can get this kind of oil from universities conducting research. The medical CBD oil needs to have more than 15% CBD and less than 0.9% THC.

There is no medical marijuana law, although there is one in the making, expected to get in session late in 2019. Also, this state does not allow the recreational use of marijuana, and anyone caught possessing an ounce of weed on them or smoking weed will get a 30-day prison stay and $200 fine. Lastly, there are retail stores carrying CBD products across South Carolina, but many people find the online purchase a more convenient way of getting their favorite CBDs.

There was some turmoil regarding the laws related to hemp cultivation in New Mexico, which even involved the Supreme Court. Now the state has a hemp cultivation program and a medical marijuana program. The use of CBD is free for all citizens of New Mexico.

CBD in the Land of Enchantment

The New Mexico legislators allowed the cultivation of hemp in this state in 2017, which was then vetoed by the Governor. To fix this issue, the matter was brought before the Supreme Court, and the veto was ruled as unconstitutional in 2018. This means that today it is legal in the state of New Mexico to cultivate industrial hemp for research and development purposes.

This state does not have a law related to the legality of CBD, meaning that it is legal to use CBD oil and other CBD products under the Federal Farm Bill, as long as these contain less than 0.3% THC and are derived from hemp.

Hemp Cultivation

The hemp plant has been cultivated since ancient times, and there is evidence suggesting that this is one of the earliest cultivated plants by people. Hemp can be used for a variety of applications such as fiber, rope and cloth production, paper, animal feed, animal bedding, bio-plastic, biofuel, and of course, the production of CBD.

The US has a good history related to hemp, as it was brought here by the first European settlers in the early 1600s. Ever since then, many people have grown hemp and it was used for a variety of uses before it was blacklisted in 1937, and completely banned in 1957.

It was allowed back on the US fields in 2014 when the 2014 Federal Farm Bill removed it from the list of banned and put it on the list of agricultural crops, and later, the 2018 Farm Bill only expanded the rules and allowances regarding hemp cultivation.

Here I give you an overview of two cannabis strains that are rich in both CBD and THC and have found use among the medical marijuana community.

Bona Dea is a mixed hybrid strain with traits from all parents. It has a good THC and CBD ratio that usually goes 1:1. The buds smell of spices, pines, and earth and the flavors go from earthy and woodsy to sweet and spicy. The effects are quite nice, with relaxation, uplifting the spirits and bringing happiness, to hunger-inducing effect. The medicinal side is very favorable, as this strain helps with depression, insomnia, stress, inflammation, pain, and relief of nausea.

3D CBD is a hybrid of undisclosed origin, but this strain has gained a lot of popularity in the medical cannabis community. It has a high CBD content that can go up to 13%. The buds smell of the earth, the woods, pines and mangoes, and the flavors it leaves are piney, woodsy, to slightly fruity. The initial effects are uplifted, talkative and happy, with strong effects on pain, stress, depression, inflammation, muscle spasm relief and dealing with insomnia.

New Mexico CBD law

After some political disparities, it was the state of New Mexico installed a law regarding the cultivation of industrial hemp. However, this law is still only for the cultivation of hemp for research purposes, and commercial farming will have to wait. The industrial hemp research program is governed by the University of New Mexico. The state allows the use of CBD oil and other CBD products, as long as these contain the federal prescribed levels of THC or less than 0.3%.

Medical marijuana

Ever since 2007, patients in New Mexico can use marijuana for medicinal applications. The patients need to qualify, and some of the qualifying conditions are cancer, HIV/AIDS, epilepsy, ALS, Alzheimer’s disease, Crohn’s disease, glaucoma, autism, multiple sclerosis, PTSD, nausea, among others.

The patients can have up to eight ounces of medical cannabis for a 90-day period, and they can grow up to 16 plants (4 mature and 12 immature plants). Currently, this state has about 70,700 registered patients that can get their medical cannabis from 77 licensed dispensaries. The medical cannabis program is run by the New Mexico Department of Health.

No weed for New Mexicans

The strict attitude of the previous New Mexican Governor had a great influence regarding the adult use of cannabis, i.e. is against it, so this state does not allow this type of fun. However, to make matters easier for her people, the current Governor signed a law decriminalizing the possession of small amounts of weed effective July 1, 2019, namely less than half an ounce will only garner a $50 fine and no penalty. Up to 1 ounce for the first time means 15 days in prison, a second offense, and anything more than one ounce is a year in jail and $1K fine.

CBD Shopper Info

The Cactus State has a growing CBD interest, meaning that more and more people are looking to reap the benefits this amazing molecule can bring. There are many retail stores that have started carrying high-quality CBD products, and most are concentrated in the larger cities like Santa Fe, Rio Rancho, and Albuquerque.

Anyone that lives too far from the brick-and-mortar CBD shops can freely order their preferred CBD product online and have it delivered right at their doorstep, usually free of extra charge.

Concluding Thoughts

Even though the previous New Mexican Governor vetoed the cultivation of industrial hemp in this state, the Supreme Court decided that this veto is unconstitutional and overthrew her decision. It is now legal to cultivate industrial hemp for research purposes in New Mexico, under a program run by the University of New Mexico.

This state has a medical marijuana program since 2007, serving over 70,000 people with state-licensed dispensaries called “Licensed non-profit producers or LNNP”. The state has decriminalized small amounts of weed, enacting this law from July 1st, 2019, meaning that people can carry up to a ½ ounce of weed and if caught will only get a $50 fine.

Lastly, it is legal to use CBD oil and other CBD products in this state, and while there are many retail stores carrying this kind of product, it is simpler to go online and order any type of product you like.

Quick facts: The State of Oregon has a law for growing industrial hemp since 2009, allowing the production, possession, and trade of industrial hemp, commodities, and products. There is a medical marijuana law here operational since 1998, and since July 2015, the recreational use of weed is completely legal here. All this said; the use of CBD products is free for all Oregon citizens, and this state is one of the best for purchasing such products in retail stores.

CBD in Oregon, the Beaver State

The State of Oregon has been growing industrial hemp since 2010, legalizing it with Senate Bill 676 passed in 2009. There are many farmers that grow industrial hemp here, and the program is governed and licenses are issued by the Oregon Department of Agriculture. Also, the trade of industrial hemp and the production of hemp derivates are legal across the state, as is the production of CBD products.

Hemp cultivation

Hemp has been cultivated by men and women for many years. The most common uses of hemp include fiber and cloth production, paper production and of course CBD and hemp oil production. Hemp was introduced in the USA in the early 1600s, and now the US Federal laws allow the cultivation of hemp across the state, with state laws further regulating its cultivation.

Hemp can be grown in a variety of soils, humidity levels, and conditions. Still, there are many places where the growing of hemp is very successful. Still, it is not so simple, as there is ample soil preparation necessary before sowing the hemp seeds, as well as some fertilization and even watering if there is no rainfall.

There are many US states where the industrial hemp is recognized as an agricultural crop and freely grown on fields. Still, all of these have local hemp laws and even requirements about the strains that are legal to be grown.

This leads me to the different varieties of cannabis, and the ones that are favored by medical cannabis users. These are predominantly CBD-rich strains and I’ve selected two for today’s article.

Tesla is a high-CBD strain with an interesting terpene profile and many desirable properties. The buds smell of fruits like raspberries, grapes, blueberries, and flowers. The flavors it leaves are spicy and remind of nuts. The effects of the Tesla strain are relaxed, uplifted, focused and happy, with strong hungry feeling. The medical side helps with stress, inflammation, muscle spasms, pain, and depression.

Harley Twin is a sativa-dominant strain with a high amount of CBD. It smells sweet and leaves a cherry aftertaste. The sativa terpene profile is very strong, with creative, energetic, euphoric and uplifting high. The medical side is also strong, with excellent anti-inflammatory actions, as well as relieving stress, nausea and minor pains.

Oregon CBD Laws

The State of Oregon has allowed the cultivation of industrial hemp across the state in 2009, and commercial production began in 2010. Since then, many farmers have begun growing this crop, and most of it is used for the production of CBD and hemp oil.

The use of CBD products in this state is completely legal as long as the CBD oil or other product contains less than 0.3% THC and is in compliance with the US federal law.

Medical Marijuana

Ever since 1998, the people in Oregon suffering from severe health conditions like cancer, nausea, PTSD, seizures, HIV/AIDS, glaucoma, chronic pain, muscle spasms, and Alzheimer’s disease can use medical marijuana. There are other health conditions that are subject to approval.

The registered patients can grow up to six mature cannabis plants and up to 18 immature seedlings and can possess up to 24 ounces of usable cannabis. Today there are about 28,170 registered patients and the medical marijuana program is run by the Oregon Health Authority.

Smoking weed is legal in Oregon

The people of Oregon voted for the legalization of weed in 2014, and this law called Measure 91 took full effect on July 1st, 2015. Since then, the state has issued 606 dispensary licenses. Today the laws of possession of weed in Oregon state that one can carry up to one ounce of weed in public completely legal, up to two ounces it is punishable with a $650 fine and anything more is punishable with a jail sentence and monetary fine. People at home can keep up to eight ounces and can grow up to four plants.

The State of Oregon taxes the sales of marijuana, and it is expected that the sales of medical marijuana will hit $59,000,000 and the recreational marijuana sales will soar up to amazing $848,000,000 by 2022.

CBD Buying Options

Oregon is a very liberal state when it comes to the use of anything marijuana and hemp-related. This state has many retail stores with plenty of high-quality CBD products. Most of these are located in Portland, Salem, Ashland, and Beaverton.

For the people that like the discretion of an online purchase, all the CBD companies online deliver their products to Oregon, additionally, you can select any type of product and check the manufacturers’ credentials by yourself.

Conclusion

Oregon farmers are growing industrial hemp since 2010, allowed by Senate Bill 676, passed in 2009. The majority of this hemp is used for the production of CBD, which is also legal to use here. There are many retail stores across the state carrying good-quality CBD products, but people are free to order their preferred CBD products online.

There is a medical marijuana program in this state active from 1998, legalized by the Oregon Medical Marijuana Act and governed by the Oregon Health Authority. Lastly, this is one of the 10 US states which have legalized the recreational use of marijuana so far. By the very liberal state policy, Oregonians can carry up to one ounce of weed with them and grow up to four plants at home without breaking the law.
